                Authorization 
The client authorizes Data Recovery Guru to conduct a diagnosis of the media provided for service to determine the nature of the damage and provide an estimate of the data recovery cost and turnaround.
The client authorizes Data Recovery Guru, its employees, independent contractors, and agents, to receive and transport this media/equipment/data to, from and between their facilities. 
The client hereby represents, warrants, and affirms that he, she, or it is the owner or the authorized representative of the property and all data stored on said property. By asking Data Recovery Guru to enter this agreement with you, as client, you declare that the foregoing representations are true and correct. You agree to indemnify Data Recovery Guru for any claims against Data Recovery Guru related to the data recovery service provided.
Failure to claim property 
Any property left unclaimed for 30 days with Data Recovery Guru will be disposed of or recycled. At which time, Data Recovery Guru shall have no liability to the client or any third party.
Limited Liability 
Data Recovery Guru's liability of any kind with respect to the services, including any negligence on its part, shall be limited to the price paid in full by the client for the services. Client and Data Recovery Guru agree that the sole and exclusive remedy for unsatisfactory work or data shall be, at Data Recovery Guru's discretion, either (a) additional attempts by Data Recovery Guru to satisfactorily recover the data or (b) a full or partial refund of the amount paid by the client. 
The parties acknowledge that the price of Data Recovery Guru's data recovery services would be much greater if Data Recovery Guru undertook more extensive liability or promised additional remedies. 
Data Recovery Guru shall provide best care for the device submitted, yet Data Recovery Guru is not responsible for any further damage to the device or data during the recovery process. Client is aware of the inherent risks of injury and property damage involved in data recovery, including without limitation, risks due to destruction or damage to the media or data and inability to recover data, or inaccurate, or incomplete data recovery. All data recovered will be kept for a period of 10 days after successful delivery to the customer. No charge will be made in the destruction of data. Data will be destroyed and thereafter no further records will be kept.
Confidentiality 
Data Recovery Guru agrees not to disclose any information or data files supplied with, stored on, or recovered from client equipment to any third parties.
Payment 
Payment is due in full on data service completion and prior to the release of data (whether shipped, delivered, picked up or downloaded), unless by special previous arrangement. 
Payment is required whether the client has data backups or not. 
Payment made after data delivery is non-refundable. 
Clients are advised to check the file list reference before making invoice payment. “No critical files recovered - no labor fee” applies only when no data recovery is possible. The client is financially responsible for all shipping costs, custom duties and taxes to and from Data Recovery Guru. Late payment is subject to an additional $20 per day, for each additional late day.
Early Service Termination Fee
Upon service approval, should the customer wish to terminate the agreement prior to the completion of recovery, then Data Recovery Guru reserves the right to charge an early termination fee of up to 50% of the service quote. None of the recovered data will be provided.

Warranty 
Data Recovery Guru makes no warranty, of its own or implied. Data Recovery Guru disclaims any warranty of any kind, for the services being provided or discussed here under. Data Recovery Guru takes no liability against expiry of warranty of the equipment, if any, before, during or after the data recovery, unless mentioned specifically. 
Declined Services 
Data Recovery Guru reserves the right to charge a fee to ship the device back or drop-it off should all services be declined and the customer wants the device back. If the client does not want it back, then there is no charge.
